Yep, many time people asking about uploading to youtube is legal or not. So here I found some material from internet. and other. so here I suggesting for you all.
There is a doctrine called Fair Use, which says that people can make use of someone else’s work under certain circumstances. There are no hard-and-fast rules, but it’s probably Fair Use if:
- The use is non-commercial (you’re not making money off of it);
- The use is “transformative;” i.e., your video is a separate and distinct work from the material you’re using. In other words, uploading a music video is copyright violation. Videotaping your 2-year-old dancing to a Prince song is not.*
- The use does not damage or dilute the marketability of the original work; i.e., people would still buy the song after watching your video.
Keep in mind, I’m not a lawyer; but I wouldn’t worry too much about the lawyers breaking down your door if you use copyrighted material in your own videos. But when in doubt, check it out.
